Terms of Service

Acceptance of these terms

These Terms of Service ("Terms") govern your use of conversionbird.com (the "Site") and our client reporting portal at clients.conversionbird.com (the "Portal"). Both are operated by Conversionbird, LLC ("ConversionBird," "we," "us"), based in San Diego, California, USA. By using the Site or Portal, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use them.

These Terms are not a services contract. Marketing, advertising, development and other client services are governed by a separate written agreement between ConversionBird and each client. If that agreement conflicts with these Terms, the client agreement controls.

Use of the Site

You may use the Site to learn about our services, read our content, book calls and contact us. You must be at least 18 years old, or the age of majority where you live, to book a call or use the Portal. We may change, suspend or remove any part of the Site at any time.

Portal access and password confidentiality

The Portal is available only to clients and the people they authorize. We issue access passwords.

  • Keep your password confidential and share it only with people in your organization who are authorized to see your reports.
  • You are responsible for activity that happens under your access.
  • Tell us right away at kyle@conversionbird.com if you think your password has been exposed or misused.
  • Portal reports contain confidential business information. Do not share them outside your organization, except with your own advisers, unless we agree in writing.
  • We may change, suspend or revoke Portal access at any time, including when a client engagement ends or if we suspect misuse.

Accuracy of reported data

The Portal displays advertising performance data pulled from your Meta, Google Ads and other ad platform accounts on your behalf. Please keep in mind:

  • Ad platforms report attributed results using their own models, attribution windows and estimates. Purchases, revenue and other conversions reported by an ad platform often differ from the orders and revenue recorded in your store, such as Shopify, or in your analytics tools.
  • Data may be delayed, revised later by the platform, incomplete, or affected by outages, API changes or tracking limits outside our control.
  • Reports are for information only. They are not financial, accounting or tax records.

Portal data is provided "as is" and "as available." Check important figures against your own systems before relying on them for business decisions.

Intellectual property

The Site, the Portal and their content, including text, graphics, logos, design, software and report layouts, are owned by ConversionBird or its licensors and protected by intellectual property laws. You may view and print Site content for your own internal, non-commercial use. You may not copy, modify, distribute or create derivative works from it without our written permission. Ownership of work product created for clients is set out in the applicable client agreement. Your own business data stays yours.

Prohibited uses

You agree not to:

  • use the Site or Portal for anything unlawful, fraudulent or harmful;
  • access or try to access accounts, reports or data you are not authorized to see;
  • share, sell or publish Portal passwords or Portal access;
  • probe, scan or test the security of the Site or Portal, or interfere with their operation;
  • scrape, crawl or harvest data or content using automated means, except standard search engine indexing;
  • upload or transmit malware or other harmful code; or
  • impersonate any person or misrepresent your affiliation with anyone.

Third-party links and services

The Site and Portal include or link to third-party services, such as Calendly, YouTube, Vimeo, Meta and Google. We do not control these services and are not responsible for their content, availability or practices. Your use of them is governed by their own terms and privacy policies.

Disclaimers

The Site, the Portal and all content are provided "as is" and "as available," without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site or Portal will be uninterrupted, error-free or secure. Content on the Site, including case studies and results, is for general information only. It does not guarantee any particular outcome for your business.

Limitation of liability

To the fullest extent permitted by law, ConversionBird and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Site or Portal. This applies even if we were advised of the possibility of such damages. Our total liability for any claim relating to the Site or Portal will not exceed one hundred US dollars (US $100). This section does not limit any liability that cannot be limited by law, or any liability set out in a separate client agreement.

Indemnity

You agree to defend, indemnify and hold harmless ConversionBird and its owners, employees and contractors from any claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or Portal, your violation of these Terms, or your violation of any law or third-party right.

Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms, the Site or the Portal will be brought only in the state or federal courts located in San Diego County, California. You consent to the jurisdiction of those courts.

Changes to these terms

We may update these Terms from time to time. We will post the new version here and update the effective date. If you continue to use the Site or Portal after changes take effect, you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent.
